Go to www.nata.org/NATAnews click on current issue. Use the arrows to page 12 "Athletic Trainers' Legal Liability for Football Related Injuries-Minimizing the Risks." Read the article. Then use the arrows to page 20, read "Tape or Not to Tape: That is the (Insurance) Question." After reading both articles, blog a response to the following questions.

  1. 1)The athletic trainers are primarily responcible for the well being and safety of the athelete, their preparedness and knowledge of injuiries puts them in control of the situation. If they make a mistake or the athelete is not treated correctly they are liable for the legal results of the athletic injury.
    2)For a athletic trainer to protect themselves from risk of being involed in a law suit, they must have a full understanding of "standard of care",they need to know the management of specific injuries based on the more recent scientific literature.
    3)Insurance is used to back the trainer up in a legal situation. Trainers found without proper insurance take a major risk when dealing with injured athelets. Choosing a insurance angent for athletic trainers is a key event. The perfect person is needed for coverage, price, benefits, and reimbursements.

    1. athletic trainers liability risks are high because if proper care is not taken to treat the athlete then all the responsibility is on them.
    2. athletic trainers protect themselves by getting liability insurance and knowing the standard or care and documenting everything that goes on.
    3. the insurance is a way to protect the trainer in legal needs and courts will side with the trainer if there is documents kept regarding comments and information on the athlete when they came in to see the trainer.

    1. AT's liability risks are high because if even the smallest detail goes unnoticed and the player is effected by it, the AT could potentially be sued.
    2. AT's can protect themselves by getting liability insurance and also fully understand the standards of care. Also be up to date on how to treat most Athletic related injuries.
    3.Just in case anything does happen, they have something to help them through the court or settlement process. Things to look at while deciding which insurance provider would be cost, coverage, and need

  4. 1. Sports trainers have high liability risks because if the trainer doesnt do what they are supposed to, they will be blamed for the effect.
    2. The athletic trainers protect themselves against liability lawsuits by filling out paperwork for everything they do and they sign security forms too.
    3. insurance protects trainers by not getting sued in the courts. they must consider documentation and wording in the insurance forms.

  5. 1.I learned that when injuries occur, the public look at how the injury could or could not have happened. Since Athletic Trainers are the main part in managing these injuries, they have to be careful.
    2.They have to understand the ‘Standard of Care’ to manage all injuries. Also examine legal cases and first hand experiences of others who have defended other athletic trainers in legal circumstances.
    3.So if an athlete gets hurt, we don’t have to worry about potential lawsuits. You must consider the amount of coverage.

  8. 1. When injuries occur around an audience there are looking at how people react to the care of the injured athlete. If the athletic trainer does not take care of the athlete in the proper way there is going to be alot of upset people. The athletic trainer dedicates there time to helping athletes. Parents, athletes, and other people involed in athletics don't want a unreliable athletic trainer working with the athletes.

    2. to protect themselves they need to have liability insurance and they need to know all the concepts of the standard of care. If the athletic trainer has all these things they are less likly to get in a bad situation with an athlete because of improper care.

    3. Having the right insurance is huge for an athletic trainer. This way if they do get into a legal situation the have the right tools. They need a good agent so that they recieve the right coverage, price, benefits, and reimbursements.

    1)Athletic Trainers need to be prepared for an injury at any time and be able to give proper care. They need to be careful to not make any mistakes so they don't end up being blamed.

    2)Understand the "Standard of Care" and have liability insurance.

  10. 1.I learned that athletic trainers are at high risk, for if something goes wrong with their patient, they are going to be the one that the blame falls on. It is essential to make sure you are following protocol, taking all the correct preventative measures, and assuring that all precautions are accounted for. Sports injuries are something that could end a career, therefore when something goes wrong, it is a big problem.
    2.They can get liability insurance to ensure that if something does go wrong when the trainer did what they were supposed to, then they will not be blamed. Also, the trainer should know the standard of care, to make sure that they are addressing situations efficiently.
    3. It is essential to have good liability insurance, for without it, when faced with a legal situation, they can have major problems. IF they do not have liability insurance, they might find themselves in a situation that can cause them to lose their credentials, career, or reputation. Having a good plan with good prices, benedicts, coverage, and agents is needed when purchasing liability insurance.

    1. I learned that athletic trainers are responsible to give the correct standard of care to their atheletes and they must follow certain procedures properly to aviod lawsuits.

    2. They need to have liability insurance just in case they get sued.

    3. Atletic trainers dont want to lose money if a case is filed and it is important to research the insurance so they can get some that will fit their needs and give them a low rate.

  14. 1) I learned that athletic trainers' liability risks are big factor in there job and if the trainer does not treat the athlete right they could be sued. which is why they must take every precaution to make sure there are no mistakes.

    1. I learned that it is very easy for the athletic trainers to get blamed for whatever happens to the athlete. They need to be very careful and explain what they are doing and why at all times to the athlete.
    2. Athletic trainers can protect themselves by getting liability insurance and explaining themselves to the athlete and parent of the athlete.
    3.Having insurance is important because they won't loose money or their job for what happens. When looking for insurance it needs to appy to what the athletic trainer deals with and at a price they can pay.

  16. 1. even though athletic trainers do what they are asked of the athletes and provide the necessary care for an injury at the time, the injured athlete will later sue the medical department that helped them just to get money to help pay for the medical expenses regarding their injury.
    2.athletic trainers need liability insurance to protect themselves.
    3.it is important that athletic trainers have liability insurance to protect themselves when working at extra events or camps because it is an investment that will pay for its self should the need arise. athletic trainers need to look for a process that involves rate comparisons, consideration for the amount of coverage per occurance, available reimbursments and the company's overall experience and reputation.

  17. 1) I learned that the trainer's liability risk is very high because basically all of the responsibility falls on the trainer. It is important for the athletic trainer to follow the accurate protocol. Also, if an athlete gets injured and the trainer has not taken the correct precautions to prevent the injury then he/ she will be blamed for the athlete’s misfortune.
    2) In order to protect themselves, it is important for athletic trainers to invest in liability insurance. Also, it is beneficial for the trainer to be up to date on the standards of care, in order to help the patient/ athlete. Finally, it is smart, as well as required, for the athletic trainer to document all injuries, in order to prevent legal matters
    3) It is important for trainers to have liability insurance because if ever involved in a legal situation, the trainer must be able to have the appropriate documents and information so that the risk of getting sued is not as high, and so that their career doesn’t become jeopardized. When buying liability insurance, the trainer should find a plan with low prices, coverage, and agents.

  18. 1. one thing i learned by reading the article was that ATs have a lot of responsiblilties and cant act with out thinking. they need to make sure that the client/patient what they are doing and how it will help.
    2.the ATs need to protect themselves by having good insurance and making sure the patient and the parents are aware of the injury and how they planned treatment will go.
    3.the importance of good insurance is that the AT will be protected from law suits. when they are looking for an insurance company they AT needs to look at the price and the coverage.

  19. 1. I learned that athletic trainers have a huge responsiblity with every athlete and it is their liability to keep the players injury free and provide prober care to injuries.

    2. Liability insurance is the only thing that keeps athletic trainers protected form liability charges. Along with proper practice of their profession which goes along with standard of care.

    3. It is imperative that trainers have liability insurance to protect them from the courts. Injury cases can be avoided as long as the trainer is keepong proper documentation, is doing their job correctly, and has this insurance. When A.T.s are looking for the right insurance company it is essential that they have good coverage, benifits, reimbursements, and low monthly prices.

  20. 1) I learned that athletic trainers have high liability risks because they are responsible for the injuries of an athlete and they have to make decisions that are in the best interest of the athlete. If they handle an injury incorrectly, it is their fault and they could get into a lot of trouble for their mistake.

    2)An athletic trainer can protect themselves from getting involved in law suits by doing everything they can to prevent injuries to their athletes and handling severe injuries properly. Also, having records/ paper work of athletes' medical histories can provide them with evidence that they're handling injuries properly if they ever get into a legal matter.

  21. 1)Learned that trainers are being targeted by lawyers in many law suites because it is said trainers are not taking proper precautions to protect the players.

    2)Trainers can make the athletes sign a waver saying they are playing at their own risk. They can also make sure they are doing their job.

    3)It is important to have liability because trainers cant prevent all injuries and sooner or later might have a law suite against them. Insurence will take care of that.

  26. 1. I learned that their liability is a key aspect in their job. They are responsible for more than just common injuries and it is their duties to prevent and treat them. If they do anything wrong then all the blame can be placed upon them.
    2. I think that they should get liability insurance to be able to protect themselves and everyone makes mistakes so I think somethings shouldnt be taken into a law suit

  27. 1. After reading the article, i learned that it is always important to be on task and aware as an athletic trainer. In some cases, an athletic trainer could suffer from a lawsuit because of a silly mistake. No matter what each and every athletic trainer much know everything there is to know about the subject. That is only logical.

    2.Athletic trainers can prepare themselves by knowing what they need to do in any situation. These responsible figures should have everything memerized and everything laid out so that if an incident was to happen, they would know exactly what to do.

    3.It is important for any athletic trainer to have liability insurance because they could be charged when doing something so little and so common they arnt even aware. When looking for insurance, it is only logical that you look to see what it includes and what benefits you will recieve. That way you will know which one is there right one you you.

    -I had learned that they are a target for lawsuits. They also are in charge of amlost everything that has to do with injuries regarding the athletes. If they do something wrong, it will most likely end up being their fault.

    2. What can athletic trainers do to protect themselves?
    -They can get the jury to look into medical theories regarding the cause of the athlete, and they must have an understanding of the "Standard of Care".

    -It is important because it is less involvment with the judge and court, it is also good to have coverage in case something bad happens. They must consider rates, annual coverage, benefits, and the companies reputation with former athletic trainers.
